New Court Diversion Program
California recently enacted Penal Code section 1001.95. This is a new diversion program that some individuals who are charged with a misdemeanor offense may be eligible to participate in. If you are deemed eligible for the diversion program, the court can suspend criminal proceedings against you for a period not to exceed 24 months. The court will require certain terms and conditions that he or she deems appropriate based on the specific charges.
Individuals charged with an offense for which a person is required to register as a sex offender pursuant to Penal Code section 290, domestic violence, or stalking are not eligible. (Penal Code § 1001.95 (e)(1)-(4).)
If you are deemed eligible for diversion and successfully complete the terms and conditions imposed by the court, the arrest upon which diversion was imposed shall be deemed to have never occurred. (Penal Code § 1001.97.)
